The time-limited demand
One of the most powerful tools in a Georgia injury case, and one of the easiest to get wrong.

What it is
A time-limited demand is a written offer to settle an injury claim for a set amount, often the policy limits, that must be accepted within a certain time. Georgia has a statute that sets out what these demands must include for certain motor vehicle claims.
Why it matters
If the insurer unreasonably fails to accept a valid demand within the policy limits, it may be exposed to a judgment above those limits. That gives the insurer a strong reason to take the claim seriously.
Why it's easy to get wrong
- Strict requirements about what must be included
- Specific rules about how it's sent and when
- The law has changed in recent years
- A defective demand may not carry the same weight
This is lawyer work. A demand sent by someone without a lawyer, or sent too early, can backfire.
