Bad faith in Georgia
Georgia law gives some protection when insurers refuse to pay without a good reason.

Two different situations
| Situation | General Georgia rule |
|---|---|
| Your own insurer refuses to pay a covered claim after a proper demand | Possible penalty and attorney fees if the refusal was in bad faith |
| A vehicle damage claim isn't handled in good faith | A separate statute may apply |
| The at-fault driver's insurer unreasonably refuses to settle within limits | The insurer may be responsible for a judgment above the policy |
Document everything
- Every letter and email with dates
- Call notes: who you spoke to, when, what they said
- Every document you sent and proof of delivery
Bad faith claims are technical. Strict notice requirements and deadlines apply. Talk to a lawyer before sending a "bad faith letter" yourself.
