The recorded statement

It sounds like a formality. It's evidence, and it's not for your benefit.

What it's used for

  • Locking you into details before you know the full extent of your injuries
  • Finding small inconsistencies to question your credibility
  • Getting you to say "I'm fine" or "I'm okay"
  • Asking about prior injuries and treatment

You can say no

You generally don't have to give a recorded statement to the other driver's insurance company.

"I'm not giving a recorded statement. Please send any questions in writing, or contact my attorney."

Your own insurance is different

Your own policy may require you to cooperate with your insurer, which can include a statement. Even then, it's smart to talk to a lawyer first and be careful and accurate.
